The final determination on the anti-dumping investigation on Flat Stainless Steel Products originating in China and Taiwan

Today, October 1, 2020, the final determination of the anti-dumping investigation on Flat Stainless Steel Products originating in China and Taiwan was published in Mexico’s Official Gazette. The applicant for the investigation was the national producer, Outokumpu Mexinox, S.A. de C.V., and various exporters from China and Taiwan, as well as Mexican importers of the investigated product, appeared.

In paragraph 493 of the Resolution, the Ministry determined that:

“[…] There are sufficient elements to support that, during the investigated period, imports of cold-rolled stainless steel flat products, originating in China and Taiwan (specifically from Hoka and YLSS), were made under conditions of price discrimination and caused pecuniary damage to the domestic industry of the like product. […] “

Injury

In the anti-dumping investigation, the Ministry concluded that:

“There are elements that support that the domestic industry faces a situation of deterioration and price containment derived from the conditions of unfair competition in which the investigated imports entered, because while in the period investigated the costs of its inputs, expressed in dollars , grew 7%, their prices only increased 1%.

The imports originating in China and Taiwan, under conditions of price discrimination, had a negative impact on relevant economic and financial indicators of the domestic industry, both in the investigated and analyzed periods, including: sales to the domestic market, market share, employment, inventories, prices, sales income, profit, and operating margin. “

Investigated Product and Exclusions

The stainless steel flat products indicated below were excluded from the product scope and, thus, excluded from the dumping and injury analysis per paragraph 82:

  • Mirror finish (No. 8).
  • Mirror finish (No. 8) embossed.
  • BA finish and thickness less than 0.3 mm.
  • BA finish and thickness greater than 1.2 mm.
  • Those with a width greater than 1319 mm.

Regardless of the foregoing, we suggest consulting the product scope established in Final Determination.

Antidumping Duties

Unlike the preliminary resolution of this investigation, the Ministry of Economy imposed the following definitive antidumping duties on definitive and temporary imports, as well as those that enter under the Eighth Rule, per paragraph 505:

a. of 0.63 dollars per kilogram for all exporting companies in China.

b. $ 0.61 per kilogram for Hoka Elements Co. Ltd and $ 0.05 per kilogram for Yuan Long Stainless Steel.

Paragraph 505, Final Determination

The Ministry did not impose anti-dumping duties on imports originating in Taiwan from exporters Yieh Mau Corp., Yieh United Steel Corporation, and other exporting companies in that country.

PRELIMINARY DETERMINATION – STAINLESS STEEL SHEET

Mexican Ministry of Economy published in the Official Gazette the Preliminary Determination of the antidumping investigation on Stainless Steel Sheet from China and Taiwan

Today, the Mexican Ministry of Economy published in the Official Gazette the Preliminary Determination of the antidumping investigation on Stainless Steel Sheet from China and Taiwan. In this antidumping investigation, VTZ is pleased to represent an exporter from Taiwan.

Antidumping duties on Stainless Steel Sheet from China

Trough this Preliminary Determination, the Ministry resolved to continue with the antidumping investigation, and:

  • The Ministry determined provisional antidumping duties on imports of stainless steel sheet , including definitive and temporary ones, as well as those entering under the Eighth Rule for the application of TIGIE (Mexican Tariff), from China, regardless of the country of provenance, which are entered by tariff sections 7219.34.01, 7219.35.01 and 7220.20.02 of the TIGIE and under the Eighth Rule by sections 9802.00.01, 9802.00.02, 9802.00.03, 9802.00.07, 9802.00. 10, 9802.00.13 and 9802.00.19 of the TIGIE, or by any other:

    a. 121.46% for Shanxi, and

    b. 88.42% for the other exporting companies in China.

  • The Ministry did not determinate provisional antidumping duties on imports of stainless steel sheet from Taiwan.

 

The Preliminary Determination will enter into force as of tomorrow.

Today, the Mexican Ministry of Economy published in the Official Gazette the notice of the antidumping investigation on aluminum discs from China.  Below, please find relevant information on the antidumping investigation:

  1. Petitioner: Almexa Aluminio, S.A. de C.V.
  2. General Product Description: Discs with an aluminum content equal or superior to 97%, diameter equal or superior to 100mm and maximum 1,100 mm, produced with aluminum alloys corresponding to the series 1000 and 3000 (“aluminum discs”); the scope does not include anodized aluminum discs nor those produced under the 5000 series.

MEXICAN TOMATO & NEW TARIFFS TO USA – THE TRADING ROOM

Mexican Tomato & AD

This Tuesday the Ministry of Economy issued a public statement regretting the decision of the Department of Commerce (DOC) regarding the termination of the Tomato Suspension Agreement, which was agreed by Mexican Exporters and renewed for the last time in 2013. This agreement a non-injurious export price was fixed.

The termination of the Agreement means that tomato exporters should pay/deposit a duty of 17.5% on the value when exporting tomato to the USA. Said percentage refers to the “dumping margin”, which was calculated provisionally in the antidumping investigation in the 90s. The DOC will continue to investigate and determine that the exports were made at less than fair value, the International Trade Commission will analyze whether the domestic industry was injured.

Notwithstanding, the parties will continue the negotiations for a new agreement. If it is reached, it will enter into force within 30 days and the provisional duties paid would be returned.

New tariffs to USA

Last week, Mexican president, AMLO, and the Underminister of International Trade, Luz María de la Mora, announced respectively that the government is preparing new tariffs as countermeasures against agricultural, industrial and steel products from the USA. The countermeasures that are being prepared are an updated version of those imposed in response to the 232 measures against Mexican steel and aluminum. Mexico still has in force the countermeasures against certain products of US, steel, aluminum, pork meat, cheese, among others… will the new measures include temporal imports?
