Antidumping Investigation on Cold Rolled Steel from Vietnam

Cold rolled steel from Vietnam is the new antidumping investigation launched by the Mexican Ministry of Economy. On July 28th, 2022, the Ministry of Economy published the Notice of Initiation Cold Rolled Steel From Vietnam.

Product under Investigation: Cold-Rolled Steel

Cold rolled sheet, alloyed or unalloyed, not plated or coated, of a thickness of less than 3 millimeters (mm), regardless of the width, including both widths less than and equal to or greater than 600 mm. The product under investigation can be offered, among other presentations, in the form of coils, sheets, strips, strips or tapes. The product under investigation includes both raw cold-rolled sheet and annealed cold-rolled sheet. In the international market, it is known as Cold Rolled Steel.

The product enters the domestic market through tariff items 7209.16.01, 7209.17.01, 7209.18.01, 7209.26.01, 7209.27.01, 7209.28.01, 7209.90.99, 7211.23.03, 7211.29.99, 7211. 90.99, 7225.50.07 and 7226.92.06 of the Mexican Tariff Schedule, including the «Eighth Rule» through sections 9802.00.01, 9802.00.02, 9802.00.03, 9802.00.07, 9802.00.13, 9802.00.15 and 9802.00.19.

Final Antidumping Determination

On December 28, 2023, the Ministry of Economy published the final determination of the antidumping investigation on cold rolled steel sheet from Vietnam. In its determination, the Ministry concluded that imports of this product were made under dumping conditions. In addition, it considered that such imports threaten to cause injury to the domestic industry. Consequently, the Ministry determined the following definitive antidumping duties:

Hoa Phat Steel Sheet Co., Ltd
Antidumping Duty: 11.64%
Posco Vietnam Co. Ltd
Antidumping duty: 25.64%
The rest of the Vietnamese companies
Antidumping duty: 79.24%

Among the most relevant aspects of the final determination, it is worth mentioning that the Ministry determined the existence of a particular market situation (PMS) in the Vietnamese cold-rolled sheet industry. In addition, the Ministry calculated a reconstructed normal value of the Vietnamese companies, instead of using the domestic prices of their sales in Vietnam. In addition, the investigation involved the participation of the Government of Vietnam.

Particular Market Situation (PMS)

Regarding the PMS, the Ministry determined in its preliminary determination that the purchase prices of inputs for cold rolled steel sheet were distorted. Both Posco Vietnam Co., Ltd. and the Government of Vietnam provided various evidence to demonstrate that such purchases are made under normal market conditions. In addition, evidence was given that the Vietnamese Government does not interfere in the industry of this product. However, the Ministry disagreed and reiterated its preliminary determination. This is the first time that the Mexican Government establishes the existence of a SEM in the final determination of an antidumping investigation.

Explanatory Note

On January 5, 2023, the Ministry published an explanatory note on the final determination. Specifically, the Ministry noticed that there was an error stating that cold rolled steel sheet could be imported without paying antidumping duties, provided «that the country of origin of the good is other than China«.

In other words, imports of cold-rolled sheet could enter the country without paying antidumping duties if the importer demonstrated that they were from Vietnam or any other country other than China. However, the Ministry modified the text of the final resolution to clarify that it must be demonstrated «that the country of origin of the good is other than Vietnam» in order not to pay such duties.

Preliminary Antidumping Determination

On September 13, 2023, the Ministry of Economy published the Preliminary Determination in the antidumping investigation on imports of cold rolled steel. Specifically, the Ministry of Economy considered that it has sufficient elements to provisionally determine the existence of dumping and injury to the domestic industry. In addition, the authority imposed the following provisional antidumping duties:

Posco Vietnam Co. Ltd
Antidumping Duties: 25.64%

Antidumping Duties: 81.06%

Among the most important aspects, the Ministry of Economy determined that the Vietnamese cold rolled steel industry has a special market situation. In particular, the Ministry considered that the production and prices in the Vietnamese market of this industry are distorted and it is not possible to use them in this antidumping investigation.

Consequently, the Ministry of Economy made a reconstruction of the normal value of this product. Based on such reconstructed normal value, the authority compared the prices of the sales in Vietnam and the export sales to Mexico. On that basis, the Ministry preliminarily determined the existence of dumping and imposed antidumping duties. Moreover, the antidumping are applicable to definitive imports, as well as temporal imports such as those of the IMMEX program. Currently, VTZ represents the only two Vietnamese companies that obtained specific antidumping duties: Hoa Phat Steel Sheet Co., Ltd. and Posco Vietnam Co., Ltd.

Analyzed period (Injury)

The Ministry established the period of analysis from October 1st, 2018 to September 30th, 2021.

Investigated period (Dumping)

Likewise, the Ministry established the period of investigation (POI) from October 1st, 2020 to September 30th, 2021.
