Removal of antidumping duties on ammonium sulfate from China

Today, the Ministry of Economy published the Notice of removal of antidumping duties on ammonium sulfate from China in the Official Gazette of the Federation. Thus, there will no longer be any antidumping duties to be paid on imports of this product originating in China. What are the implications of the antidumping duty removal?

Since October 2015, imports of ammonium sulfate from China and the United States were subject to the payment of antidumping duties in Mexico. In particular, the Ministry of Economy determined the imposition in the following terms:

In March 2022, the Ministry of Economy decided to extend the antidumping duties until October 2025. This was for both U.S. and Chinese ammonium sulfate. Previously, the Ministry of Economy had temporarily suspended the collection of antidumping duties on this product in May 2022.

However, the publication of this notice implies the definitive elimination of antidumping duties on imports of ammonium sulfate from China as of September 26, 2024. However, the antidumping duties applicable to Honeywell Resins & Chemicals and other U.S. exporters will continue to be applied.

VTZ Participation

The VTZ team played an active role in all the processes linked to the removal of antidumping duties on ammonium sulfate from China. In particular, VTZ advised the exporting company Wuzhoufeng Agricultural Science & Technology, Co. Ltd. as well as numerous importers such as Isaosa, S.A. de C.V. and Promotora Nacional Agropecuaria Mexicana, S.A. de C.V. in the antidumping investigation concluded in 2015.

Subsequently, VTZ supported these importing companies in challenging the imposition of antidumping duties through administrative appeals, annulment proceedings, and amparo actions. The importing companies obtained a favorable ruling ordering the Ministry of Economy to review part of its antidumping Determination with accurate and updated information in 2024. In response to this ruling, the Ministry of Economy requested the national producers of ammonium sulfate to submit such information, but the national producers were unable to provide it.

As a result, the Ministry determined that it lacked sufficient evidence and information on the existence of dumping of ammonium sulfate from China. Consequently, the Ministry of Economy determined to remove the antidumping duties on imports of this product originating from China.
