Anti-Subsidy Investigation on Imports of Metformin from India.

Petitioners

The company Sinbiotik S.A. de C.V. (“Sinbiotik”) is the domestic producer in Mexico and requested the anti-subsidy investigation

Investigated Product

Metformin or metformin hydrochloride, whose technical name is “1, 1-Dimethylbiguanide monohydrochloride”.

Mexican Tariff Item

Metformin enters under tariff item 2925.29.99 of the Mexican Law of General Import and Export Tariffs.

National Programs:

  • Tax Refund Scheme.
  • Advance Authorisation Scheme.
  • Export Promotion Capital Goods scheme.
  • Export Oriented Units.
  • Production Linked Incentive (PLI) Scheme for Promotion of Domestic Manufacturing of critical Key Starting Materials (KSMs)/ Drug Intermediates and Active Pharmaceutical Ingredients (APIs) in the Country.
  • Production Linked Incentive (PLI) scheme for Pharmaceuticals.

Regional and Local Programs:

  • Special Economic Zones – Income Tax Exemption.
  • Special Economic Zones – Goods and Services Tax.
  • Maharashtra Package Scheme of Incentives
  • Exemption from taxes on electricity.
  • Gujarat – Assistance for Micro, Small and Medium Enterprises (MSMEs).

Calculation of subsidy amount:

Unit amount, based on the percentages established in each incentive program granted by India and other state authorities.

Period of Investigation:

July 1st, 2022, to June 30th, 2023.

Period of Analysis:

July 1st, 2020, to June 30th, 2023.

Deadline to Participate

The deadline to submit the questionnaire is March 8, 2024, although an extension may be requested.
