En el artículo, se analizan las respectivas reservas de México en el TLCAN, cómo la reforma energética afectó dichas reservas y hasta que punto se vieron beneficiados los inversionistas extranjeros. No obstante que la reforma energética fue implementada en el 2014, este tema no ha sido explorado profundamente y está sujeto a un intenso debate.
Toda vez que es imminente que el TPP no entrará en vigor, las obligaciones de México bajo el capítulo 11 TLCAN son, ahora más que nunca, relevante para los inversionistas de los Estados Unidos y Canada y sus inversiones en el sector petrolero o energético. Por ejemplo, si los Estados Unidos denuncia el TLCAN de acuerdo con el artículo 2205, los inversionistas de dicho país no estarán protegidos por otro tratado y solamente por el Derecho Consuetudinario Internacional. Una cuestión que, seguramente, no será tomado ligeramente por los EEUU, mucho menos por sus inversionistas.
